Terms and conditions
AGA Føroyar Sp/f valid from September 1st 2024

§ 1 Overall objective
1.1.These agreement- and delivery terms cover all deliveries and quotations, unless other written agreement is statet between the parties.

§ 2 Quotations
2.1 For a quotation to be valid it must be accepted within 30 days the latest.

§ 3 Prices
3.1 The presented prices are, if nothing else is agreed upon, without tax and other fees.
AGA Føroyar has the right to demand the customer to pay for any increase in tax and fees if these are clearly included in the price.
3.2 Presented prices are fixed when delivery is on agreed time as stated in the quotation/ order confirmation
3.3 AGA Føroyar reservs the right to update prices and discounts with a 14 days warning if nothing else is stated.

§ 4. Payment
4.1 Payments may be made with credit cards or by bank transfer on account 6460-220.647.3
The following credit cards are accepted: Dankort Visa, Visa Dankort, MasterCard.
4.2 The amount will be charged from the customer’s credit card when the goods have been dispatched or when the customer has been notified that the goods are ready for collection.

§ 5. Execution and dispatch of the goods
5.1 If the order is placed before 10am on weekdays, it will be executed the same day. Orders placed after 10am will be executed the next day.
5.2 AGA Føroyar Sp/f executes the dispatch of the goods. In case AGA Føroyar Sp/f does not deliver the goods itself, the delivery will be arranged by Posta or G-Cargo.
5.3 If the order is placed before 10am on weekdays, it will be sent the same day. Orders placed after 10am will be delivered to Posta or G-Cargo for delivery the next day.
Delivery by Posta is according to the route of Posta.
If the goods are ordered before 10am to places that are connected to the mainland, delivery by G-Cargo is the same day. Other dispatch of goods usually takes 2-3 days.
Freight prices are the generally presented prices at our carrier.
5.4 If special circumstances affect the delivery such as weather and bad driving conditions, delivery might be delayed.

§ 6. Gas cylinder etc.
6.1 It is the customers responsibility to make sure that all gas cylinders, containers and other vessels are returned to its owner AGA Føroyar in same condition as when delivered to the customer.
If all items are not returned, it is the customers responsibility to refund AGA Føroyar the cost price for the same container/vessel .
Such containers/vessel are continously the property of AGA Føroyar and neither the customer, its estate nor creditors can acquire these
6.2 The customer is responsible for storing and using the containers/vessels legally correct and in a secure manner, and to make sure that insurances cover responsibility, fire, explosion, theft and vandalism of AGA Føroyar’s property.
6.3 Gas cylinders are let to customers for rent. Further specifications are set by AGA Føroyar.
6.4 Complaints about statements or calculations regarding rent, must be done immediately, or within 20 days the latest after reciving the invoice.
6.5 The customer must accept that representatives for AGA Føroyar, if considered necessary, at any time can examine the storage- and production premises to count gas cylinders etc.

§ 7 Terms of payment
7.1 The terms of payment are 20 days from invoice date.
7.2 If payment is late, penalty fees will apply. This will be fixed by AGA Føroyar and stated on the invoice.

§ 8. Right of withdrawal
8.1 In case you regret your purchase, the goods can be returned within 14 days.
8.2 The goods can be delivered to either our store in Akranesgøta 2, 100 Tórshavn or be sent to us. In case AGA Føroyar Sp/f shall pick up the goods, a payment of DKK 130 will be charged.
8.3 The customer will be refunded the full amount of the purchase, if the goods are in the same condition as when bought.
8.4 If the goods are returned, or if we shall pick up the goods, we need the following information about the customer: phone number, bank account number and mode of delivery. The information can be sent by mail to aga@aga.fo The amount will be transferred to the bank account once the goods have been received.

§ 9 AGA Føroyar’ responsibility
9.1 Responsibility for defects in sold product
When complaints regarding purchases from AGA Føroyar are in due time witin 2 year of purchase/delievery, AGA Føroyar can either fix the error or replace the item.
AGA Føroyar has no responsibility if the purchased good have not been stored in a proper way,handled incorrectly og or not used as prescribed by AGA Føroyar. Any claim for damages will then be rejected.
9.2 Responsibility for delays
In case a delivery has been substancially delayed, the customer can cancel the order.
If AGA Føroyar and the customer have agreed upon a gradual delivery, the customer can only cancel the delayed parts of the order, that should have been delivered already.
The customer must inform AGA Føroyar about quantity and preferred time of delivery in good time. Especially if there is an increase in consumption compared to normal. AGA Føroyar must be informed if the customer wants increased delivery for a shorter or longer period of time.
Apart from what is written here, the customer has no other authorization due to any possible delays.
9.3 Force majeure
In case an on time delivery is being held up by circumstances that AGA Føroyar has no influence on, such as strike, IT disturbance or transportation problems, AGA Føroyar has the right to postpone the delivery or cancel the order. The customer must be informed of this at first chance.
9.4 Product liability
9.4.1 AGA Føroyar is to be held responsible by currant Faroese legislation regarding product liability in that sense the legislation invariable holds AGA Føroyar responsible for such damages and derfor AGA Føroyar’s responsibility can not be limitet by law.
9.4.2 AGA Føroyar’s product liability is limited to 5 million DKK
9.4.3 In cases where damages are made by AGA Føroyar corresponding what is mentioned above, and the damage is also partly caused by the customer, the responsibility is shared by the two parties. Liability is shared according to damage responsibility
9.4.4 In case AGA Føroyar is obliged to pay for damages by a third party, it is the customers responsibility to keep AGA Føroyar clear of responsibility that exceeds its liability according to above mentioned.
9.5 General limitation of liability
Even due to incautiousnes AGA Føroyar’s liability can not include financial loss, loss of time or other indirect loss or collateral damage of any kind even if the responsibility is based on regular compensation rules or other basis.
This limitation does also apply for AGA Føroyar’s product liability in case this is not put aside or being limited by indisputable Faroese legislation regarding product liability

§ 10 AGA Føroyar’s Intangible right
10.1 The customer must respect AGA Føroyar’s right to patent, brands, distinctive features of the shop, patterns, know-how and other intangible rights.
Furthermore the customer must never conceal, take away or modify brands on Aga Føroyar’s products.

§ 11 Complaint
11.1 In case the customer wants to make a complaint regarding our products or service, please contact aga@aga.fo
11.2 It is also possible to contact the Consumer Ombudsman in case the customer wants to make a complaint about misleading marketing, spam, unreasonable terms of agreement in purchase agreement or breach of the payment act, please see below link

§ 12 Dispute
12.1 Any disputes between the parties must be brought before The Faroese Court

Only the Faroese version has legal validity.
